This Privacy and Terms of Use Policies (the “Policy”) applies to Warriors2Mentors (W2M) sites,  and Advise, Train, Guide (ATG LLC) ™, a New Mexico Limited Liability Company (the  “Company”) and governs data collection and usage. By accessing or using the Company’s website,  you consent to be bound by the date practices and terms described herein.  

Changes to this Policy. 

We reserve the right to update or modify this Policy at any time, so please review it frequently.  Changes and clarifications will take effect immediately upon their posting on the website. If we  make material changes to this policy, we will notify you here that it has been updated, with an  updated “Last Updated Date.” Your continued use of the services and access of the website and its  materials after such updates will be deemed your acceptance of the revised Policy. We want you  to be aware what information we collect, how we use it, and under what circumstances, if any, we  use and/or disclose it. If our site or course is acquired or merged with another company, your  information may be transferred to the new owners so that we may continue to sell products to you. Further, Company may offer additional features or services on the Warriors2Mentors site, or any  other site owned by Company. Access to such features or services may require you to enter  additional agreements or authorizations.  

Web privacy policy. 

We take your privacy seriously, and we want you to know how we collect, use, share and protect  your information. In addition to this privacy policy, users of any Warriors2Mentors site should  consult the W2M site terms of use as well as any product specific terms and conditions that apply.  This policy applies to any websites owned by Advise, Train, Guide (ATG LLC) ™. 

What information we collect. 

We respect the right to privacy of all visitors to this W2M site. We do not collect any information  that would personally identify you unless you voluntarily choose to provide it by sending us an  email. Any personal information that you submit, is shared only with those people in the Company  who need this information to respond to your question or request and those internal areas that will  utilize the information to improve Company operations. Information submitted to the Company  using any of our online forms may be collected to ensure technical functionality. It will also be  utilized to address any inappropriate use of our website(s). We do not save personal information  to use for illicit purposes, nor do we provide it to any other organizations. Attention: See Notes 1,  2, 3, and 4 below.

Note 1: When you enroll as a student or subscriber (“learner”) on our site or related courses, as  part of the enrolling process, we collect the personal information you give us such as your name  and email address. 

Note 2: Email marketing: we may send you emails about our site and related course(s), registration,  course content, your course progress, or other updates. We may also use your email to inform you  about changes to the course, survey you about your usage, or collect your opinion. 

Note 3: Our course and site is hosted by Thinkific Labs Inc. (“Thinkific”). They provide us with  the online course creation platform that allow us to sell our product/services to you. Your data is  stored through Thinkific’s data storage, databases and the general Thinkific application. They store  your data on a secure server behind a firewall. 

Note 4: You acknowledge and agree that the Company may disclose your personal information  without notice if required to do so by law, regulation, legal process or good faith belief that such  action is necessary. This may include disclosing your personal information in response to  subpoenas, court orders, government requests, or other legal obligations, or if we believe such  action is necessary to comply with legal requirements or protect our rights, property, or safety, or  the rights, property, and safety of others. We will make reasonable efforts to notify you of any  such disclosure, unless prohibited by law. 

Email communications, newsletter, and related services. 

Email communications that you send to us via the email links on our site may be shared within the  Company, so we are able to address your inquiry. We make every effort to respond in a timely  fashion once communications are received. Once we have responded to your communication, it is  discarded or archived, depending on the nature of the inquiry. 

Please note the email functionality on our site may not provide a fully secure or confidential means  of communication. There is a possibility that your email communication may be intercepted or  accessed by unauthorized third parties during transmission. If you wish to ensure your privacy of  communication, we recommend using an alternative, more secure method. 

How do you get my consent? 

When you provide us with personal information to register as a Learner on our site, make a  purchase, or participate in Company courses, you consent to our collection and use of that  information solely for the purpose of fulfilling these specific actions.  

If we ask for your personal information for a secondary reason, like marketing, we will either ask  you directly for your expressed consent, or provide you with an opportunity to say no. 

How do I withdraw my consent?

Surveys. 

At this point in time, we do not conduct online surveys. However, we do monitor data that gives  us a general idea of how many visits our site experiences in a given period. That information does  not identify users nor their locations and is not saved, distributed, or used in any fashion by the  Company. 

IP addresses. 

Our web server automatically collects the Internet Protocol (IP) address of computers that access  our site. An IP address is a unique identifier assigned to your device when you connect to the  Internet. While this information is not personally identifiable, as multiple users may share the same  device or network, we use it in aggregate form to analyze how our site is being used and to improve  the experience of our visitors.  

Cookies and other tracking technology. 

Our service provider collects information about visitors to our site using cookies and similar  technologies, such as web beacons, pixel tags, and other tracking methods. As our ability to  leverage advanced technologies evolves, we may use session cookies to track visitor’s navigation  across our site during their sessions, in order to better understand how users engage with our  content and improve their experience.  

How we use the information we collect. 

The Company collects and users your personal information in the following ways: 

• To operate and deliver orders and requests for products, services, or information • Processing returns and exchanges 

• Tracking and confirming online orders 

• Operating, evaluating, and improving our business 

• To provide you with notices about your account 

• To carry out the Company’s obligations and enforce our rights arising from any contracts  entered between you and us, including for billing 

• In any other way we may describe when you provide the information and for any other  purpose with your consent

Data retention. 

We will retain information for as long as necessary to provide our services, fulfill our legal  obligations, resolve disputes, and enforce our agreements. 

Except as required or authorized by law enforcement investigations or other valid legal processes,  we will not share any personally identifiable information we receive from you with any third  parties outside of the Company. 

We may share some information to third parties. 

We may share your personally identifiable information with third parties who we have engaged to  assist us providing our services (e.g. web service providers). In each case, we will ensure that these  third parties have agreed not to use or disclose your personal information except for the purpose  of helping us deliver the services. 

Except as noted above for newsletters and surveys, the Company does not knowingly provide any  third-party access to your IP address and email address. The Company does not sell, rent or lease  its customer list to third parties. 

Our web service provider may provide third parties with aggregate statistics about our visitors,  traffic patterns and related site activity with third parties. These statistics reflect general site-usage  trends gathered during visits to our website each month, but they do not contain behavioral or  identifying information about any individual member unless you have explicitly consented to share  such details.  

To assess the effectiveness of (W2M), we use third-party web analytics tools that collect non identifiable information from your browser. This includes data such as the site or advertisement  that led you to us, your IP address, general geographic location, browser and platform information,  and the pages you visit on our site. 

Protecting your privacy. 

Advise, Train, Guide (ATG LLC) ™ cannot guarantee the security of any information you transmit  to us, and you do so at your own risk. Please be aware that electronic transmission over the Internet  are not always secure and may be subject to interception. While we take measures to protect your  information, we cannot provide an absolute guarantee of the security or confidentiality of such  transmissions.  

If you reached this site using an ad from someplace else. 

If you arrived at an W2M website via an anomalous advertisement, the ad may have been served  to you based on your interests or selected for you based on your browsing activities. At this time  the Company does not maintain a private server and therefore does not create nor use Company  specific advertisements. Always use caution and internet security protocols when surfing the web. 

Protecting children's privacy. 

We are committed to safeguarding the privacy of children online. In compliance with applicable  laws, we do not knowingly collect, use, or disclose personal information from individuals under  the age of 18 without appropriate parental consent. 

Links to other websites. 

Our website(s) may link to other websites, many of which have their own privacy policies. Be sure  to review the privacy policy on the site you're visiting. Please remember; when you click on links  on our course site, they may direct you away from our site. We are not responsible for the privacy  practices of other sites and encourage you to read their privacy statements. 

Policy updates. 

We may need to update our privacy policy and/or terms of use as technology changes and as  Advise, Train, Guide (ATG LLC) ™ evolves. If we make significant changes to the Policy, we'll  post a prominent message on our website(s).

The W2M and any Company sites and services are intended for use by individuals 18 years of age  or older. The sites and services are not directed to children under the age of 18. User’s under the  age of 18 should get the assistance of apparent or guardian to use this site. 

Prohibited Use and User Responsibilities.  

You agree not to: 

• Upload or transmit any communications or content of any type that may infringe or violate  any rights of any party. 

• Use this website for any purpose that violates local, state, tribal, national or international  laws. 

• Use this website to distribute advertising or other unsolicited material to any third party. • Use this website to post or transmit material that is unlawful, obscene, defamatory,  threatening, harassing, abusive, slanderous, hateful, or embarrassing to any person or entity. • Attempt to disable, hack or otherwise interfere with the proper functioning of this website. 

If you use any part of the site that requires secure access, you are responsible for maintaining the  confidentiality of your account and password and for restricting access to your computer. You  agree to accept responsibility for all activities that occur under your account or password. 

Order limitations. 

We reserve the right to reject any order or to limit quantity on any order, without providing a  reason. If your order is rejected, we will make reasonable efforts to notify you via the email address  you provided at the time of order. 

Termination of use. 

Company may, in its sole discretion, terminate your account or restrict access to the W2M and/or  Company sites at any time. Further if in Company’s sole judgement you fail, or Company suspects  that you have failed to comply with any term or provision of this Policy, Company may terminate  your order or services at any time without notice to you and accordingly Company may terminate  access to the services. You will remain personally liable for the full cost of any orders placed or  charges incurred prior to termination or breach.  

Company reserves the right to change, suspend or discontinue all or any part of the site at any time, without prior notice. 

Suspension of Services. 

Company shall not be responsible for any resulting loss if the fulfillment of any terms or provisions  of this Agreement is delayed or prevented by any occurrence beyond Company’s reasonable  control, including but not limited to acts of God, fires, floods, wars, accidents, government laws,  pandemic, community disaster, or any situation that would substantially interfere with Company’s  performance of services. In the event of any such occurrence, Company reserves the right to  suspend performing the service immediately and until such time as Company determines that the  circumstances are again suitably available and safe. If such event and providing circumstances  permit, Company shall give no less than twenty-four (24) hour notice of such suspension.

Blogs and interactive media. 

By using the blogging features (if available) or posting information to any of our sites, you grant Company the irrevocable right to reproduce, copyright, release, distribute, publish, display, edit,  modify, create derivative works from and otherwise use your submission for any purpose, in any  form, and on any media. You further release Company for any legal reason purpose, including but  not limited to social media, commercial products, education, course materials, video footage, sales,  marketing, or any other medium and any other media forum.  

If you use blogging features or otherwise post information to any of our sites, you agree you will  not: 

• Post material that infringes on the rights of any third party, including intellectual property,  privacy, or publicity rights. 

• Post material that is unlawful, obscene, defamatory, threatening, harassing, abusive,  slanderous, hateful, or embarrassing to any other person or entity as determined by Company  in its sole discretion. 

• Post advertisements of solicitations for business. 

• Post chain letters or pyramid schemes. 

• Impersonate another person including but not limited to a spouse, child, or sibling. • Allow another person to use your credentials for posting or viewing comments. • Post the same note more than once or "spam." 

Company reserves the right (but is not obligated) to: 

• Remove communications that fail to conform with this Policy. 

• Terminate a user's access to the entire site or specific features such as the blog (when  activated). 

• Edit or delete any communications posted on the blog (when activated) features, regardless  of whether such communications violate these standards. 

E-commerce/Security. 

If you make a purchase on our site, we may use a third-party payment processor such as Stripe or  PayPal. Payments are encrypted through the Payment Card Industry Data Security Standard (PCI DSS). Your purchase transaction data is stored only as long as is necessary to complete your  purchase transaction. All direct payment gateways adhere to the standards set by PCI-DSS as  managed by the PCI Security Standards Council, which is a joint effort of brands like Visa,  MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure  handling of credit card information by our site and related courses and its service providers.

One-time charges. 

A valid credit card number, expiration date, and card security code is required for all purchases. If  we are unable to charge the full cost of your purchase to the credit card you provide, we may cancel  your order or request an alternate form of payment. Company designated credit card processor will  collect your credit card information and related personal information for its use in processing your  payment for the products or services ordered by you. Any complaints or grievances regarding the  processing of your payment should be addressed to Company at the contact information given  below. You understand that the prices for products and services may be changed from time to time,  but that the website will reflect current prices. 

Responsibility for charges and fees. 

You are solely responsible for all charges and applicable fees (including delivery charges, taxes  and any fees assessed by your bank) associated with your order. 

Refund Policy. 

If for any reason you are not satisfied with your order of the chosen services, you may stop the  services at any time. Because the Company has invested considerable time and effort in the  Services, if you wish to withdraw or discontinue services for any reason, you will remain fully  responsible for all payments and the full cost of the services and/or order. NO REFUND OR  PARTIAL REFUND WILL BE PROVIDED. 

Security.  

To protect your personal information, we take reasonable precautions and follow industry best  practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered, or  destroyed. If you provide us with your credit card information, the information is encrypted using  secure socket layer technology (SSL) and stored with an AES-256 encryption. Although no  method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI 

DSS requirements and implement additional generally accepted industry standards. 

Indemnification. 

You agree that you will indemnify, and hold harmless Company , its affiliates, owners, employees,  officers, agents, and representatives from any damages, loss, judgments, costs, or expenses  (including reasonable attorneys' fees and costs) incurred by Company as a result of or in connection with the services provided contrary to the terms of this Policy arising out of a claim by a third party  relating to materials you have posted, or any action taken by you on websites owned and/or  managed by Company. 

Intellectual property. 

All services materials, trademarks, brands, logs, designs, slogans, trade dress, patents, copyrighted  and copyrightable materials of the Company (the “Company Intellectual Property”) and all 

goodwill associated therewith supplied to you by the Company or appearing on the Company’s  website or social media accounts, shall belong to and remain the sole property of the Company,  and you shall not have or acquire any right to copy, reproduce, publish, share, distribute, or  otherwise disseminate the Company Intellectual Property unless granted such permission in a  signed writing from Company. No right or license is granted, by implication or otherwise, to use  any Company Intellectual Property. You may view, download, display and print a single copy of  these materials on a single computer for personal, noncommercial use only, so long as: you do not  alter or modify the materials in any way; you include all applicable notices and disclaimers  (including copyright notices); and you do not use the materials in a way that suggests an association  with Company or an affiliates You understand and agree that title to these materials shall not pass  to you or any other user.

You should assume that everything you have access to through the  Company sites, services, and on social media is copyrighted unless otherwise noted and may not  be used, except as provided in this Policy or otherwise stated by Company in writing.  

The provisions of this section shall survive the termination of this Policy and/or termination of  your relationship with Company to the extent necessary to effectuate the terms contained herein.  This Policy, however, does not constitute a grant or act as an intention or commitment to grant any  right, title, or interest in the Company’s innovations, intellectual property, or the Company  Confidential Information, to you.

Errors on any Company Site. 

Content, prices, and availability of products and services are subject to change without notice.  Errors will be corrected when and where discovered, and Company reserves the right to revoke  any offer and to correct any errors, inaccuracies or omissions including after an order has been  submitted, confirmed and whether or not your credit card has been charged. If your credit card has  already been charged for the purchase and your order is canceled, Company will issue a credit to  your credit card account for the amount charged. Individual bank policies will dictate when this  amount is credited to your account. 

Limitations of liability.

Dispute Resolution. 

In the event of dispute, please first submit the complaint to Company in writing to the contact  information provided below, detailing the complaint or dissatisfaction. The delivery date of such  complaint (the “Complaint Date”) shall serve as formal notice of such complaint to the Company.

Should any dispute of any kind or nature arise from the relationship between you and Company,  you and Company agree to first put forth best efforts to resolve any dispute, recognizing their  mutual interests, and attempt to reach a satisfactory solution through communications via email. 

However, if after 30 days, mutual consent proves unsuccessful, you agree that upon notice by  Company, any unresolved controversy or claim shall be submitted to binding arbitration. Further,  any dispute, claim, or controversy arising out of or in connection with the Policy, including but  not limited to any issues relating to the validity, interpretation, enforcement, or breach of this  Policy, shall be resolved through binding arbitration, rather than in court. The arbitration shall be  conducted in accordance with the rules of American Arbitration Association (AAA), and the  arbitration proceedings shall take place in a location deemed appropriate by Company. 

The arbitrator’s decision shall be final and binding on all parties, and judgment on the arbitration  award may be entered in any court of competent jurisdiction. Both parties waive any right to a jury  trial and agree that the arbitration will be the sole and exclusive remedy for any disputes. 

The costs of arbitration, including the arbitrator’s fees, shall be shared equally by both parties  unless the arbitrator determines otherwise. Each party shall be responsible for its own legal fees  and expenses. 

Any judgement on an arbitrator’s award, if made, is binding and may be entered into any court  having the appropriate jurisdiction. By consenting to the Policy, you agree to a modification of the  statute of limitations such that any arbitration must be commenced within one (1) year of the date  of the act, omission, or other conduct complained of as submitted on the Complaint Date or shall  otherwise be forfeited forever. 

General Terms.  

This Policy, or rights granted hereunder, may not be assigned, sold, or leased or otherwise  transferred in whole or in party by you. 

No waiver of any terms of provision of the Policy shall be binding unless executed in writing by  the party entitled to the benefit thereof.  

If it is found in a final judgment by a court of competent jurisdiction (not subject to further appeal)  that any term or provision hereof is invalid or unenforceable, (i) the remaining terms and provisions  hereof shall be unimpaired and shall remain in full force and effect and (ii) the invalid or  unenforceable provision or term shall be replaced by a term or provision that is valid and  enforceable and that comes closest to expressing the intention of such invalid unenforceable term  or provision.  

The headings of the sections hereof ae inserted for convenience only and shall not be deemed to  constitute a part of the Agreement nor to effect the meaning of it. 

The provisions of this Policy, including the: Dispute Resolution, Intellectual Property,  Disclaimers, and General Terms, shall survive the termination of this Policy and the services to  the extent necessary to effectuate the terms contained herein.
